These VITAUNITS General Terms of Use (“Terms”) govern your access to and use of the VITAUNITS online application, leasing, communication, and property-management portal (“Service”).
By accessing or using the Service, creating an account, submitting an application, uploading documents, clicking “I Agree,” “Continue,” “Submit,” or otherwise using the Service, you agree to these Terms.
References to “you” or “user” mean any applicant, prospect, resident, co-applicant, guarantor, occupant, or other person using the Service.
References to “VITAUNITS,” “we,” “us,” or “our” mean the platform provider. References to “Housing Provider,” “Property,” “Owner,” “Landlord,” or “Management Company” mean the property owner, landlord, property manager, leasing office, or authorized housing provider responsible for the property or rental transaction.
1. Purpose of the Service
The Service is a technology platform used to support rental application, leasing, communication, document, maintenance, payment, and property-management workflows.
Depending on the property and available features, the Service may allow users to:
* inquire about housing
* submit rental applications
* upload documents
* communicate with a leasing office or property manager
* complete application steps
* review rental criteria and disclosures
* authorize screening or verification services
* electronically sign documents
* receive notices and updates
* manage leasing or tenancy-related tasks
* submit maintenance requests, if available
* access resident-related information, if available
Use of the Service does not guarantee housing approval, unit availability, pricing, lease execution, renewal, or continued tenancy.
2. Housing Provider Responsibility
VITAUNITS is a software platform. The Housing Provider is responsible for property operations, leasing decisions, rental criteria, rent amounts, fees, deposits, lease documents, notices, resident screening decisions, maintenance decisions, legal compliance, and communications with applicants or residents.
VITAUNITS does not:
* own, lease, or manage rental housing unless expressly stated separately
* make final rental approval or denial decisions
* act as a broker, landlord, property manager, attorney, credit reporting agency, debt collector, payment processor, or insurer
* provide legal advice
* guarantee any housing transaction, approval, rent amount, availability, lease term, or result
Any dispute regarding a rental decision, lease, rent, fee, deposit, maintenance issue, or tenancy should be directed to the Housing Provider.
3. Eligibility
You must be at least 18 years old or otherwise legally authorized to use the Service and enter into binding agreements.
By using the Service, you represent that:
* you are legally able to use the Service;
* all information you submit is true, accurate, current, and complete;
* you will keep your information updated;
* you will not use the Service for unlawful or fraudulent purposes.
4. Account Registration and Security
Some features may require an account or secure access link.
You are responsible for maintaining the confidentiality of your login credentials, access links, passwords, and account information. You are responsible for activity that occurs under your account or access link.
You agree to notify the Housing Provider or VITAUNITS if you believe your account or access link has been compromised.
You may not use another person’s account or access the Service on behalf of another person unless you have lawful written authorization.
5. Application Information and Documents
You may be asked to submit personal information and documents, including identification, income information, employment information, rental history, vehicle information, pet information, household information, screening authorizations, and other application-related materials.
By submitting information or documents through the Service, you authorize VITAUNITS, the Housing Provider, and authorized service providers to collect, store, process, transmit, display, and use that information as reasonably necessary for application, leasing, verification, screening, compliance, fraud prevention, recordkeeping, communication, and tenancy-related purposes.
You are responsible for ensuring that all information and documents are accurate and complete.
6. Accuracy and Misrepresentation
You agree not to submit false, incomplete, misleading, altered, forged, or fraudulent information or documents.
Providing inaccurate or misleading information may result in:
* denial of an application
* cancellation of approval
* cancellation of a pending lease
* termination of account access
* referral to the Housing Provider for further action
* other remedies available under applicable law or lease terms
7. Consent to Contact
By providing your phone number, email address, or other contact information, you authorize the Housing Provider, VITAUNITS, leasing team, property staff, agents, and authorized service providers to contact you regarding your inquiry, application, lease, account, tenancy, maintenance, notices, payments, or related services.
Communications may occur by:
* phone
* email
* portal message
* text message/SMS, where separately authorized
* voicemail
* automated or prerecorded message, where permitted by law
* other reasonable communication methods
You certify that you are the owner, subscriber, or authorized user of any contact information you provide.
8. Fair Housing and Equal Housing Opportunity
VITAUNITS supports fair housing compliance. Housing Providers using the Service are expected to comply with the Federal Fair Housing Act and all applicable state and local housing laws.
Rental criteria and housing decisions must be applied without unlawful discrimination based on protected characteristics, including where applicable:
* race
* color
* religion
* sex
* national origin
* familial status
* disability
* sexual orientation
* gender identity or expression
* ancestry
* marital status
* source of income
* lawful housing assistance
* any other protected category under applicable law
Applicants or residents needing a reasonable accommodation should contact the Housing Provider.
9. Screening and Third-Party Services
The Service may connect to or support third-party services, including:
* credit reporting
* background screening
* eviction history checks
* identity verification
* income verification
* payment processing
* electronic signature services
* document storage
* communication tools
* insurance or deposit alternatives
* other property-management service providers
Third-party services may be subject to separate terms, privacy notices, consent forms, and disclosures. VITAUNITS is not responsible for third-party services except as required by applicable law or contract.
The Housing Provider, not VITAUNITS, is responsible for the final application decision.
10. Consumer Reports and Application Decisions
If consumer reports or screening reports are used, they are obtained and used according to applicable law, including the Fair Credit Reporting Act where applicable.
You may have rights to receive adverse action notices, obtain copies of reports, and dispute inaccurate information.
VITAUNITS does not guarantee the accuracy of third-party reports and does not make final rental approval or denial decisions unless expressly stated in a separate written agreement.
11. Payments
If payment features are available, payments may be processed by a third-party payment processor or the Housing Provider.
You are responsible for:
* submitting accurate payment information
* ensuring sufficient funds
* reviewing payment amounts before submission
* paying any lawful fees or charges disclosed by the Housing Provider
* resolving returned payments, chargebacks, or failed transactions
Payment terms, refunds, deposits, rent obligations, and processing fees may be governed by the Housing Provider’s lease, application terms, posted fee disclosures, or payment provider terms.
12. Electronic Records and Signatures
Use of electronic records and signatures is governed by the separate Electronic Signature, Electronic Records & Electronic Communications Consent.
You may be required to agree to that consent before submitting an application or signing documents electronically.
13. Property-Specific Terms and Disclosures
Each property may have its own rental criteria, fee disclosures, deposit rules, pet policy, occupancy standards, move-in requirements, state-specific notices, or other property-specific terms.
Those property-specific terms are incorporated into your application process when presented to you. If property-specific terms conflict with these General Terms, the property-specific terms control for that property and transaction, to the extent permitted by law.
14. Fee and Rent Disclosures
Before submitting an application or signing a lease, you may be presented with fee, rent, deposit, or recurring charge disclosures based on the property’s settings and applicable law.
You are responsible for reviewing these disclosures carefully before continuing.
Fees, deposits, rents, and required charges may vary by property, unit, location, lease term, pet status, parking, utilities, and other factors.
15. Prohibited Conduct
You agree not to:
* use the Service for any unlawful purpose
* violate fair housing laws or other applicable laws
* submit false, fraudulent, incomplete, or misleading information
* impersonate another person
* sign or submit documents without authority
* access another user’s account or information
* interfere with security features
* upload malware, viruses, or harmful code
* attempt to reverse engineer the Service
* copy, scrape, sell, or misuse Service content or data
* harass, threaten, abuse, or mistreat staff, applicants, residents, vendors, or other users
* use the Service in a way that disrupts operations or harms others
16. Intellectual Property
The Service, including its design, software, workflows, content, text, logos, graphics, and functionality, is owned by VITAUNITS or its licensors and is protected by applicable intellectual property laws.
You may use the Service only for its intended purpose. You may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works from the Service unless expressly permitted by law or written agreement.
17. Feedback
If you submit suggestions, ideas, comments, or feedback about the Service, you grant VITAUNITS the right to use that feedback without restriction or compensation for purposes such as improving the Service, developing features, or creating related products.
18. Availability and Changes to the Service
VITAUNITS may modify, suspend, limit, or discontinue any part of the Service at any time.
We do not guarantee that the Service will always be available, uninterrupted, secure, or error-free.
19. No Legal Advice
The Service does not provide legal advice. Documents, workflows, notices, criteria, and settings provided through the Service are tools for Housing Providers and users.
Users and Housing Providers should consult qualified legal counsel regarding legal rights, obligations, rental criteria, screening, notices, lease language, disputes, or compliance matters.
20. Privacy
Use of the Service is subject to applicable privacy notices and policies. Personal information may be collected, stored, used, and shared as described in those policies and as reasonably necessary to provide the Service.
Information may be shared with Housing Providers, property owners, staff, service providers, screening vendors, payment processors, legal advisors, government authorities where required, and other parties as permitted by law.
21. Suspension or Termination
VITAUNITS or the Housing Provider may suspend or terminate your access to the Service if:
* you violate these Terms
* you misuse the Service
* you submit false or fraudulent information
* your account presents a security risk
* the Housing Provider no longer uses the Service
* the Service is discontinued
* termination is otherwise permitted by law
Termination of portal access does not cancel obligations already incurred under an application, lease, payment agreement, or other legal document.
22. Disclaimer of Warranties
To the fullest extent permitted by law, the Service is provided “as is” and “as available.”
VITAUNITS disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, security, availability, or error-free operation.
Some jurisdictions do not allow certain warranty exclusions, so some exclusions may not apply.
23. Limitation of Liability
To the fullest extent permitted by law, VITAUNITS will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost data, loss of goodwill, service interruption, or unauthorized access, arising from use of or inability to use the Service.
To the fullest extent permitted by law, VITAUNITS’ total liability for claims related to the Service will not exceed the amount you paid directly to VITAUNITS for use of the Service, or $100, whichever is greater.
Some jurisdictions do not allow certain liability limitations, so some limitations may not apply.
24. Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless VITAUNITS, its owners, officers, employees, contractors, service providers, affiliates, and agents from claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys’ fees, arising from:
* your use or misuse of the Service
* your violation of these Terms
* false, inaccurate, or misleading information you provide
* your violation of applicable law
* your violation of another person’s rights
* unauthorized use of another person’s account or information
25. Governing Law
These Terms are governed by the laws of the state where the applicable property is located, unless another governing law is stated in a valid agreement between the parties.
Property-specific disputes may be governed by the lease, application terms, property-specific disclosures, or applicable law.
26. Changes to These Terms
VITAUNITS may update these Terms from time to time. Updated Terms will be posted in the Service with a revised “Last Updated” date.
If changes materially affect your rights or obligations, you may be required to accept the updated Terms before continuing to use the Service.

28. Acknowledgment
By clicking “I Agree,” “Continue,” “Submit,” checking an acknowledgment box, creating an account, submitting an application, or using the Service, you acknowledge that:
1. you have read and understand these Terms;
2. you agree to be bound by these Terms;
3. you understand VITAUNITS is a software platform and not the final rental decision-maker;
4. you understand property-specific terms and disclosures may also apply;
5. you agree to provide true, accurate, current, and complete information; and
6. you understand that use of the Service does not guarantee application approval, unit availability, or lease execution.
